When a house, land or other property in Turkey passes to several heirs, disagreements may arise over whether the property should be sold, retained or divided.

A common question is whether one heir can request a sale even when the other heirs do not agree.

As a general rule, Turkish law does not require an heir to remain indefinitely in an inheritance community.

Can One Heir Request Partition?

Yes. Under Article 642 of the Turkish Civil Code, each heir may request partition of the estate unless a contractual or statutory restriction requires the community to continue.

Accordingly, unanimous consent of all heirs is not always necessary.

An heir may ask the court to divide the property in kind where possible or to order a sale where an appropriate physical division cannot be made.

Is Mediation Required Before Filing a Lawsuit?

Yes. Disputes concerning the partition of movable or immovable property and the dissolution of joint ownership are subject to mandatory pre-litigation mediation.

If the parties reach an agreement during mediation, the dispute may be resolved without continuing to litigation. If no agreement is reached, a lawsuit may be filed following the final mediation report.

Which Court Handles the Case?

Partition and dissolution-of-joint-ownership proceedings fall within the jurisdiction of the Civil Court of Peace.

The court first considers whether division in kind is legally and practically possible. If it is not, the court may order the property to be sold and the proceeds distributed according to the parties’ respective shares.

Can Another Heir Completely Prevent the Sale?

An heir’s objection to a sale does not, by itself, eliminate another heir’s right to seek partition.

There are exceptions. For example, the Turkish Civil Code permits postponement where immediate partition would substantially reduce the value of the relevant property or estate. The particular ownership structure and circumstances must therefore be examined in each case.

Is a lawsuit necessary if all heirs agree?

No. If the heirs agree on the sale or division of the property, the matter may generally be resolved without contested litigation.

Can only one heir bring the case?

Yes. An individual heir may request partition without obtaining the consent of every other heir.

Does a partition case always result in a sale?

No. Division in kind may be ordered where appropriate. Sale becomes relevant where such division is not possible or suitable.
