The refusal of a residence permit application can affect both a foreign national’s life in Türkiye and subsequent applications. The first step is to review the refusal decision together with the record of notification. Refusal of an application, cancellation of an existing permit, non-renewal and a removal decision are different administrative acts. Their presence in the same file does not mean that they all have the same deadline or legal protection.

This article concerns adverse decisions on residence applications made from within Türkiye. Visa matters, international protection and administrative detention applications may follow different rules. In particular, when asking “Can I stay in Türkiye if I bring a lawsuit?”, it is necessary to distinguish opening a court case from preserving an existing lawful basis for stay.

First identify the grounds for refusal and the permit category

Under Article 25 of Law No. 6458 on Foreigners and International Protection, the governorates issue and notify decisions refusing applications made within Türkiye, refusing renewal or cancelling permits. The decision is notified to the foreign national, their legal representative or their lawyer. The notification must also explain how rights of challenge can be exercised and the other relevant rights and obligations. The assessment takes account of family ties, the duration of residence in Türkiye, conditions in the country of origin and the best interests of the child.

The permit category is the starting point for assessing whether the grounds for refusal are lawful. For a short-term residence permit, the requirements and grounds for refusal in Articles 32 and 33 must be examined. Inconsistencies between the stated purpose and supporting documents, address or accommodation conditions, use of a permit for a purpose other than that for which it was granted, or a valid removal or entry-ban decision require different responses. Short-term permit rules cannot simply be applied to family or student residence permits. Law No. 6458

For example, a file in which an address document was overlooked requires different preparation from a refusal based on an entry ban. In the former, the document’s contents and the record of its submission matter; in the latter, the separate act underlying the refusal must also be investigated. Obtaining a new document later does not, by itself, establish that no deficiency existed when the decision was made.

The filing deadline is generally 60 days

Where no separate special deadline applies, an annulment action against a residence permit refusal must be brought before the administrative court within 60 days. The period starts on the day after written notification. The notification date and the date on which the decision was issued may differ; calculating the period solely from the date printed on the decision is incorrect.

Under Articles 7 and 8 of the Administrative Judicial Procedure Law (İYUK), holidays count towards the period; if the last day is a holiday, the period extends to the end of the next working day. The rule concerning the judicial recess must also be examined against the actual calendar. If the validity of notification is disputed, acting on the earliest possible starting date is safer than waiting on the assumption that the period has not begun.

These 60 days are not a limitation period for a debt; they are the time limit for bringing an administrative action. The court considers expiry of the filing period, which may prevent examination of the merits. Any period or statement concerning departure in the refusal document must be assessed separately from this litigation deadline. Having time left to sue does not mean that a lawful right to stay exists throughout that time. Law No. 2577, İYUK

How does an application to the administration affect the deadline?

Article 11 of İYUK allows the person concerned, within the litigation filing period, to ask the superior authority—or, if there is none, the authority that issued the act—to revoke, withdraw or amend the act, or issue a new one. A properly made application suspends the filing period already running. If no response is given within 30 days, the request is deemed refused.

Following an express or deemed refusal, the period resumes from where it stopped; the days elapsed before the application remain counted. For example, if 20 days had already elapsed before the application, it must not be assumed that a fresh 60-day period arises following refusal. Records showing the receiving authority, the relief requested and the submission date should be retained.

Not every telephone conversation, information request or new e-İkamet application automatically qualifies as an Article 11 application. The request directed against the refusal decision must be clearly formulated. Administrative review does not automatically suspend execution of the decision either. This option should be assessed together with the litigation deadline and any urgent need for protection. İYUK Articles 11 and 27

Bringing a lawsuit does not automatically create a right to stay

Under Article 27 of İYUK, bringing an administrative action does not automatically suspend execution of the administrative act. Filing a claim against a residence refusal therefore does not, by itself, create a new residence permit or work permit. The implications of the application document, the previous permit and the refusal notification for lawful stay must be checked separately.

Suspension of execution may be requested in the lawsuit. For the court to grant it, both conditions must exist: the act must be manifestly unlawful, and its execution must cause harm that is difficult or impossible to remedy. If family separation, ongoing education or serious health needs are involved, they must be explained with specific supporting documents; merely using these phrases in the petition is insufficient.

A suspension of execution order does not automatically remove every other administrative act in the file. If there is a separate entry ban or removal decision, the scope of each must be examined. A decision on a request for suspension of execution may be challenged once within seven days starting on the day after notification. İYUK Article 27

If there is a removal decision, do not miss the separate seven-day deadline

Under the current Article 53 of Law No. 6458, the deadline for bringing an action against a removal decision is seven days from notification. The person applying to the court must also inform the authority that issued the decision. Subject to the foreign national’s consent, the law provides that removal will not take place during the filing period or, if judicial proceedings are brought, until those proceedings conclude. This protection is not an automatic consequence of a residence refusal lawsuit; nor does it amount to the grant of a residence or work permit.

In its decision of 6 October 2021, E.2016/2078, K.2021/4589, the Tenth Chamber of the Council of State examined a removal decision and the related cancellation of a family residence permit separately. The majority rejected the appeal concerning removal because that part of the judgment was final, and upheld dismissal of the challenge to the residence cancellation based on the removal act that had become final. There was a dissent concerning the residence cancellation. The decision illustrates the connection between these two acts; it does not establish that every refusal case will have the same outcome. The historical 15-day removal filing period mentioned in the judgment must not be used today. Full judgment

Which documents should be in the court file?

The refusal decision, notification records, relevant passport pages, previous permits, the e-İkamet application and submitted documents should be assembled together. Any request for missing documents and the response, address records, tenancy or accommodation documents and records supporting the application’s purpose should also be included. Marriage and birth records matter for family ties; school records and care arrangements for a child; and current medical documents for health-related grounds.

Documents should be arranged chronologically, identifying which were submitted to the administration before the decision. The court may be asked to obtain the administrative file. The petition should explain not only personal difficulties but also the specific factual or legal error in the decision. Depending on the case, inadequate examination, incorrect assessment or failure to consider family interests and the child’s best interests may be raised.

Which court should hear the case, and what can be expected?

The dispute falls within the administrative courts’ jurisdiction. Where no special territorial jurisdiction rule applies, Article 32 of İYUK designates the administrative court where the authority that issued the act is located. The respondent administration should be identified from the heading of the decision and the authority that made it.

An annulment action aims to set aside an unlawful refusal; bringing proceedings or obtaining a favourable judgment does not mean that the requested permit category will automatically be granted in every case. The first review of the file should clarify three separate issues: the final day for filing, the current legal basis for stay and the need for urgent suspension of execution. Trying to resolve the residence matter solely by making a new application may result in missing the deadline to challenge the earlier refusal.
