A refusal of a work permit application is not necessarily a problem that can be solved simply by uploading the same documents again. Missing documents, an employer's failure to meet assessment conditions, the foreign national's professional qualifications and public order concerns require different files. First establish which application was refused, on what grounds and by notification to whom.
Refusal of an initial application, refusal of an extension and cancellation of an existing permit are different administrative acts. The foreign national's previous permit, current basis for residence and whether they are actually working must also be examined separately. The objective is not merely to submit an objection, but to document the alleged unlawfulness, preserve the deadline and avoid incorrectly assuming that the objection itself authorizes work.
Obtain both the refusal decision and the notification record
Article 21 of the International Labour Force Law, No. 6735, regulates notification of refusals of work permit or exemption applications and cancellation of issued documents. It separately identifies notification to the employer or to a foreign national holding the specified independent or indefinite permit or Turquoise Card. For an application for employment with an employer, checking only the foreign national's email may be insufficient; the employer's records should also be checked.
Do not confuse the decision date with the notification date. Preserve the application number, complete refusal letter, electronic notification and service records, system history and any documents received by the employer. Nor should the legal date of electronic service automatically be equated with the day the message was first opened. Calculate the deadline after examining the notification method used. Law No. 6735, Article 21
How should the 30-day objection be prepared?
Interested persons may object to the Ministry's decisions under this Law within thirty days of notification. The Ministry's current guidance states that objections to work permit refusals are made through the e-İzin system by uploading an explanatory petition and documents. It is necessary to verify completion in the system and its date, rather than merely preparing the application. Ministry guidance on applications and objections
The petition should clearly identify the application and decision numbers, the grounds for refusal, the response to those grounds and the outcome requested. Number the annexes and connect each document to the allegation it supports. General statements such as “the employer needs this worker” or “the foreign national likes Türkiye” may not address an assessment condition or the specific refusal ground.
Thirty days is not a limitation period for a debt; it is the deadline for the special administrative objection. Do not assume that resubmitting the same letter after missing the deadline reopens every remedy against the earlier decision. Keep the objection and litigation calendars together.
Select documents according to the refusal ground
Article 9 of Law No. 6735 contains different grounds, including inconsistency with international labour force policy, an insufficient justification for employing a foreign national, absence of the required qualifications or expertise, failure to meet assessment criteria, false or misleading documents and failure to complete an application within the prescribed period. Public order or security concerns are separately addressed. Documents addressing one ground do not automatically resolve another. Law No. 6735, Articles 7 and 9
For employer-related refusals, company records, operational and financial documents, employment information, the job description and the actual business need may matter. For professional qualifications, diplomas, experience and any required equivalence or preliminary authorization documents are considered. Numerical employment, salary and financial eligibility conditions should be checked against the current criteria applicable to the application date and sector; one threshold does not apply to every sector.
In a missing-document dispute, show what the Ministry requested, when the request arrived and when the documents were uploaded. Under Article 7(7), postponement for completing missing information cannot exceed thirty days, except where a force majeure event is documented. This thirty-day period concerns a different stage from the objection period following refusal.
Public order grounds can be examined against specific facts
In its decision of 22 June 2022, E.2017/3116, K.2022/3433, the 10th Chamber of the Council of State examined cancellation of a Russian national's work permit following intelligence information. Considering the absence of supporting concrete documents beyond the information stated in the file and the other circumstances, the majority reversed the administrative court's dismissal of the claim. The dissent considered that the judgment should be affirmed.
The administrative act in this case dates from 2009 and the period of the repealed Law No. 4817. The decision does not establish that every security-based refusal today is unlawful, or that a permit must always be granted where there is no criminal conviction. Its useful point is judicial examination of the grounds for refusal or cancellation against the particular file. The outcome was a reversal, rather than an order directly granting a new work permit. Do not confuse objection and litigation deadlines
If the objection is rejected, administrative litigation becomes relevant. An annulment action is brought before the competent administrative court, rather than a labour court. In the absence of a special territorial jurisdiction rule, Article 32 of the Administrative Judicial Procedure Law (İYUK) refers to the location of the authority that made the administrative act. Ankara administrative courts may therefore be relevant for acts of the Ministry's central administration; the employer's city is not an automatic jurisdiction rule.
İYUK Article 7 provides a general sixty-day period for administrative court proceedings where no special period applies. This and the thirty-day objection period under Article 21 of Law No. 6735 are distinct concepts. Do not proceed on the assumption that “I objected, so there is no deadline anymore” or “every response starts a fresh sixty days.” Notification of the act, the objection date, the response or absence of a response and the legal character of the application must be examined together. İYUK Articles 7, 11 and 32
An application falling under İYUK Article 11 suspends the litigation period that has begun; if no response is given within thirty days, it is deemed rejected. Following express or implied rejection, the remaining period runs, taking account of the time that elapsed previously. The effect of the special objection under Law No. 6735 on the deadline must be assessed separately in the particular file. The calendar should not be left open indefinitely while awaiting an official response.
An objection does not itself confer a right to work or remain
Residence permits and work permits are different. Subject to the exceptions concerning protection statuses in Article 12 of Law No. 6735, an ordinary residence permit does not authorize work. A foreign national whose initial work permit application was refused cannot begin work merely because they have lodged an objection. The duration and scope of any existing permit must be checked separately. Law No. 6735, Article 12
Bringing proceedings does not automatically suspend the refusal's operation either. A stay of execution may be requested by demonstrating both manifest unlawfulness and harm that would be difficult or impossible to remedy under İYUK Article 27. Granting or implementing a stay does not automatically amount to a work permit in every case; the decision's scope must be examined. İYUK Article 27
Following refusal of an extension or cancellation of a permit, the basis for residence should also be reviewed. An independently valid residence permit may not resolve the work authorization issue. Any separate removal decision has its own remedies and deadlines; the work permit objection should not be assumed to suspend that decision automatically.
When is a fresh application worthwhile?
The Ministry's guidance states that a fresh work permit application is possible once the deficiency causing refusal has been remedied. However, a new application does not replace the litigation deadline for the earlier decision. Reapplying may be practical where a missing document has been supplied; simply renewing the form may not resolve an unchanged security record or an unmet condition.
The statutory extension application window begins sixty days before the permit expires and ends before expiry. Applying for an extension after expiry creates a refusal risk. A strong file places the decision and service records, application history, documents answering the refusal grounds and work–residence position on the same timeline.
