What this guide covers

Foreign nationals preparing to transfer from family to short-term residence after divorce.

A short questionnaire explains which records may matter and produces a document checklist. It does not assess eligibility or predict a case outcome.

Documents discussed in this guide
  • Passport, family-residence cards and full permit records
  • Marriage, divorce judgment and finality records
  • Court decision concerning victim status, where applicable
  • Address, accommodation and applicable condition records
  • e-Residence, appointment, submission and deficiency records
  • Administrative decisions, full service and any child/family-ties file

A foreign national separating from a Turkish spouse often first asks whether they may remain in Türkiye until the expiry date printed on their card. The date alone does not answer that question. Examine the marriage’s legal status, permit type, periods spent under family residence, any court decision concerning domestic violence and previous administrative measures together. Divorce proceedings, divorce taking legal effect, termination of family residence and transfer to another permit are distinct stages.

1. First verify that the existing status is actually family residence

Marriage does not itself grant family residence or citizenship. Years of marriage may include stays under short-term, student or work permission. The special route in Article 34(6) of the Law on Foreigners and International Protection concerns a foreign spouse of a Turkish citizen who has stayed for at least three years under family residence. The marriage certificate and permit cards or administrative permit records therefore answer different questions; neither substitutes for the other.

Identify the card’s title, issuing ground and covered dates. If the sponsoring spouse is not a Turkish citizen, do not automatically apply this specific divorce provision; separately assess eligibility for another permit category. Temporary or international protection documentation is also different from an ordinary family-residence card. Start by identifying the status accurately: selecting the wrong application category can compound documentary and timing problems.

2. Three years of marriage is not three years of family residence

Article 34(6) permits the grant of short-term residence; it does not create an automatically acquired permit on the third anniversary. Establish the family-residence periods through previous cards, renewal decisions and administrative records. For example, four years of marriage with the first two years spent under student residence cannot be assessed solely from the wedding date. Examine the effects of gaps between cards or transfers to other categories against the actual file.

The finality record also matters when distinguishing delivery of a divorce judgment from its legal effect. Keep the initiating petition, reasoned judgment and finality certificate separate; do not construct the transfer timetable from a hearing date or oral statement alone. A foreign divorce judgment’s legal effect in Türkiye requires separate verification. The guide collects no dates and calculates no personal deadline; it identifies the records needed.

3. What does the domestic-violence exception change?

Article 34(6) dispenses with the three-year condition where the relevant court decision establishes that the foreign spouse was a victim of domestic violence. Article 30(8) of the implementing regulation likewise addresses submission of a court decision concerning victim status. This exception means a person below the three-year threshold should not be told simply to wait for three years. Its existence does not dispense with other residence conditions or the application process.

Review the complete court decision, the facts it establishes and any related case records together. A police report, medical record, petition and protective order are not interchangeable documents. Do not assume in advance that every protective order conclusively satisfies this condition, or that only a criminal conviction can be relevant. Assess the nature and actual reasoning of the decision; do not enter personal accounts of violence into this guide.

4. Do not postpone a transfer until the printed card expiry

Article 26(1) of the implementing regulation requires a permit holder intending to remain after the issuing ground ends to apply to the relevant governorate for an appropriate new permit within ten days of that ground ending. Paragraph 2 provides for termination of the existing permit as of the date its basis disappeared. Do not therefore treat the card’s remaining printed period as a safe waiting period in every case; examine the legally effective event alongside administrative records.

While divorce proceedings remain pending, knowing that a case was filed does not automatically determine every residence consequence. Separately examine the marriage, intention to live together and conditions in Articles 35–36. A sponsor’s death also follows a distinct timetable: regulation Article 30(9) separately provides for use of family residence until expiry and access to short-term residence without a duration condition. Do not transplant the ten-day explanation for one event to every family change.

5. Applying from Türkiye does not guarantee a permit

Article 22(1)(f) permits applications to the governorate from Türkiye when transferring from family to short-term residence; Article 29 allows a request for a permit matching the new purpose of stay. In its decision of 20 October 2021, E.2016/594, K.2021/4945, the Council of State’s 10th Chamber found it unlawful, on the particular facts, to require the applicant to leave again and obtain a specially annotated visa. The annulment outcome was affirmed on the reasoning that the administration should assess the merits and short-term residence conditions.

The decision does not require a permit for every applicant or establish that every historical permit remains valid today. Distinguish the lower court’s account suggesting a permit should be granted from the Council of State’s requirement for substantive assessment. Do not copy historical statutory quotations in the judgment as current rules. Assess Article 32’s purpose and supporting records, accommodation, address and other requirements under current wording and the actual file.

6. How should the application and document file be assembled?

Select the appropriate transfer category and purpose in e-Residence; distinguish application, appointment and submission of documents. Check the current official document list and case-specific requests from the competent provincial directorate. Creating a draft form or booking an appointment alone does not demonstrate completion of every step. Retain evidence showing when and on what ground the application was received, together with any request for missing material.

A practical file includes passport and complete permit records, marriage/divorce documents, finality status, family-residence periods, the relevant court decision where applicable and evidence of the new stay conditions. Compare address, accommodation and relevant insurance records with the current list. Where children are involved, separately organise custody, actual family ties and the child’s circumstances. An unchecked document is not automatically a mandatory omission; the actual facts determine why a particular record is needed.

7. Which period applies after refusal or cancellation?

Under Article 25, refusal, non-renewal or cancellation and available remedies are notified to the person; family ties, residence duration, circumstances in the country of origin and the child’s best interests must be considered. Absent a different special period, Article 7’s sixty days for challenging an ordinary residence decision start on the day following written notification. This is an administrative filing period, not the three-year permit condition or limitation of a private-law receivable. In the absence of a special rule, consider the administrative court where the deciding authority is located.

An administrative request meeting Article 11’s conditions and lodged within the filing period may suspend that period; thirty days without a reply produce an implied refusal, after which the remaining court period requires separate calculation. Ordinary correspondence or a fresh form does not invariably create a new sixty days. Filing a case also does not itself stay the measure under Article 27; interim-stay conditions require separate assessment. If a removal or detention decision exists, do not rely on this guide’s ordinary permit timetable; promptly examine that separate measure and its specific remedy.
