An actor may reserve a filming day, decline another offer and attend the notified location, only for the producer to say that no filming means no payment. The answer does not depend solely on whether the camera ran. Examine whether a binding agreement exists, whether the relationship is employment or an independent contract for work, the cancellation reason and the actor’s readiness. Postponement, final cancellation and termination of the agreement should not be treated as the same event.

The name of the acting agreement is not decisive

Dependent performance, remuneration and the actual operation of the relationship matter under Article 393 of the Turkish Code of Obligations and Article 8 of the Labour Law. Assess scheduling, integration into the organisation, instructions, continuity and the promised result together. Invoicing or a freelance label does not resolve the whole issue. Conversely, every production instruction does not automatically create employee status.

In its decision of 6 May 2015, E.2014/21290, K.2015/16592, the Ninth Civil Chamber examined an actor’s payment dispute concerning the film Nefes-Vatan Sağolsun. It classified that particular relationship as a contract for work linked to creation of the film and reversed because the labour court should have declined subject-matter jurisdiction rather than dismissed on the merits. It does not hold that all actors are independent or that every cancelled shoot must be paid.

What does Article 408 address where there is employment?

Article 408 regulates payment where the employer culpably prevents performance or defaults in accepting it. Readiness and a proper offer to perform matter. Failure by the producer to organise the set differs from the actor’s non-attendance. Saying that no filming occurred does not remove pay obligations in every case caused by the employer’s own prevention.

The provision also states that performance prevented in these circumstances cannot later be required. Its conditions must first be established, however. An agreed working schedule, a mutually accepted replacement day and a possible date mentioned only during negotiations differ. No single general conclusion about payment for a second filming day applies to every schedule change.

Which deductions may affect the payment calculation?

Article 408 provides for deduction of expenses saved because of prevention, earnings from other work and benefits deliberately not earned. The claim therefore is not invariably the unchanged contract figure. Document who owed travel, accommodation and preparation costs, which were avoided because of cancellation, and whether other work was performed during the same period.

For example, one day cancelled by the producer for an actor in monthly dependent employment differs from complete cancellation of a project undertaken independently for one advertisement. A declined alternative job may be useful evidence, but lost earnings are not established without examining the offer’s reality, conflicting dates and payment conditions. The same loss should not be claimed twice under different headings.

Cancellation and termination under an independent contract for work

If the relationship is a contract for work, payment is not calculated as though Article 408 directly applied. Where the client ends the agreement before completion, Article 484 addresses payment for work performed and compensation for all the contractor’s losses. Examine the actor’s preparation or completed performance, saved expenses, actual loss and cancellation clause together. The whole contract price is not automatically compensation in every case.

A temporary postponement does not necessarily end the agreement. Conversely, being told to await news indefinitely does not establish that every day may be blocked without payment. Clarify the parties’ undertaking, dates and duration, and whether a replacement schedule was accepted. The actor’s own termination notice requires separate examination rather than being treated as cancellation by the producer.

How can readiness and the cancellation be documented?

Preserve the signed agreement and annexes, confirmed call sheet, acceptance correspondence, travel and set-access records. Identify who sent the cancellation, when, and whether it concerned one day or the project. Keep original correspondence and context alongside screenshots. An unconfirmed audition or offer should not be presented as a concluded engagement.

In writing to the producer, specify the date and performance for which the actor was ready, seek clarification of the cancellation or postponement, and identify the payment item sought. Separate due dates, advances and partial payments. Informing the manager does not invariably replace a demand to the actual contracting party; check the manager’s authority and producer’s correct legal identity.

Which court, mediation and enforcement route applies?

For employment, examine current subject-matter jurisdiction under Article 5 and venue under Article 6 of Law 7036: the labour court and connections to the defendant’s domicile or place of work/transaction matter. Check mandatory pre-action mediation under Article 3 for employment money and compensation claims. The 2015 decision’s classification of its particular contract does not determine jurisdiction for every acting dispute today.

For an independent agreement, separately assess the general court, commercial-litigation criteria and Article 5/A coverage. A corporate producer alone does not make every payment claim commercial. Consider Articles 6 and 10 for ordinary contractual venue. This article concerns filming remuneration and cancellation claims; performer-right infringement or exploitation-permission disputes should not automatically be assigned the same jurisdiction.

Non-judgment enforcement may be considered for a due money claim; an objection does not establish the claim as final. Article 62 provides seven days from service to object to an ordinary payment order; Article 67 provides one year from service of the objection on the creditor for objection-annulment proceedings. Article 3’s mediation rule also matters for employment-related objection-annulment claims. Commencing enforcement does not itself cure classification or evidence gaps.

Wage limitation, cancellation notice and procedural periods

Article 32 of the Labour Law provides five-year limitation for wages. For independent contract-for-work claims examine Article 147(6) and its exception; for differently characterised claims assess the relevant special rule and Article 146’s general period. Maturity matters under Article 149. Not every item necessarily becomes due on cancellation or shares the same limitation period.

Article 3(17) suspends limitation and prevents expiry of forfeiture periods between application to the mediation office and the final report. An ordinary cancellation message or discussion with a manager does not have the same effect. A different remedy such as reinstatement requires separate examination of special periods. The full guide below distinguishes contract classification, document preparation and time risks without requesting personal dates or documents; it guarantees neither remuneration nor compensation.
