Although a marriage record matters for a family residence permit, the file consists of more than proof of marriage. The applicant’s family relationship, the sponsor’s status, income, health coverage for the family and accommodation records are assessed together. In particular, accepting a Turkish citizen sponsor’s written income declaration differs from dispensing with the income condition. Preparation should identify which record supports each requirement, without promising approval.
1. Distinguish the applicant from the sponsor first
Article 34 of Law No. 6458 covers the foreign spouse of specified sponsors, their or their spouse’s foreign minor child, and dependent foreign child. It does not include every relative. Supporting foreign parents or living with a sibling does not automatically bring them within the family residence category. Alongside the marriage or child relationship, examine the applicant requirements in Article 35.
A sponsor may be a Turkish citizen, a person covered by the Blue Card framework or a person with an eligible foreign status. For an ordinary foreign residence-permit sponsor, the requirement of at least one year’s permitted residence matters. Separately check Article 35(2)’s exception for research-residence or work-permit holders, persons covered by Article 28 of Law No. 5901 and foreigners married to Turkish citizens. A Turkish citizen sponsor is not expected to accumulate a year’s foreign residence. Refugee and subsidiary-protection files have the special assessment under Article 35(4); temporary protection is not equivalent to those statuses.
2. Apply both income floors together
Article 35(1)(a) requires both monthly total income no lower than the minimum wage and income of at least one third of that wage per family member. The implementing Regulation’s Article 31 refers to Article 40(5)(b), clarifying that the sponsor is included. Counting only foreign applicants or ignoring the overall minimum-wage floor produces an incomplete calculation. This article explains the structure rather than quoting a current wage amount.
If the minimum wage is represented by M, the one-third shares for a sponsor and spouse total 2M/3, but the floor remains M. For a sponsor, spouse and two children, the per-person calculation rises to 4M/3. These are hypothetical illustrations only. Identify family composition, the applicable amount and acceptable income against the actual file. Meeting the arithmetic does not satisfy the other permit requirements.
3. What changes for a Turkish citizen sponsor’s declaration?
E-İkamet’s official family-application checklist accepts a written income declaration for a Turkish citizen sponsor. It would be inaccurate to describe payroll evidence as invariably mandatory. However, that evidential simplification is not an exemption from the statutory income standard. It also does not justify inaccurate statements about other family or status conditions. Read the current application output together with any file-specific additional request.
For a foreign sponsor, identify whose salary, pension, rental or other income records are involved and which period they cover. Do not present an account balance as identical to monthly income. Examine source, regularity, the requested stay and the integrity of the evidence together. With several sources, avoid double-counting the same income or treating another person’s money as the sponsor’s own. This article alone cannot establish acceptance of a particular record.
4. Insurance must cover the family, not just the sponsor
Article 35(1)(b) requires health insurance covering all family members. The sponsor’s insured employment alone does not establish that the foreign spouse and children can actually access coverage. Check coverage and commencement/expiry for each person. For example, a record showing only the sponsor’s name does not replace checking the spouse’s inclusion; separate coverage evidence may be needed.
Social Security Institution coverage, bilateral social-security arrangements and appropriate private insurance are different evidential routes; requiring everyone to buy the same private policy is poor preparation. Regulation Article 22(13)–(14) addresses coverage for the requested period alongside annually renewable private insurance for certain longer requests. Do not therefore assume one policy for the entire period is always required. Establish the record’s official character, family coverage, validity and any applicable exception.
5. Accommodation and family records support different requirements
The sponsor’s address registration differs from accommodation suitable for the family’s size and general health and safety standards. A tenancy agreement supports use of accommodation, whereas address registration is another record. Check consistency of names, address, family members and actual use. Verify current official processing conditions for the accommodation’s location before applying; signing a lease alone does not establish permit approval.
Marriage and birth records, custody/consent where needed, and dependency evidence establish the relationship. Separately check applicable legalisation or apostille and Turkish translation for foreign documents; do not assume every record follows an identical authentication chain. Article 35 separately requires the sponsor’s criminal record to establish no conviction for offences against family order within the preceding five years. Income evidence replaces neither relationship nor criminal-record evidence.
6. Organise the application and deficiency timetable
First identify current lawful stay, initial application/extension/transfer and sponsor status. Then select the correct category through e-İkamet and follow the submission and appointment steps in its output. Under Article 24, extension applications may be made from sixty days before expiry and must be made before expiry. That window is not the period for challenging a refusal. Saving a form, submitting evidence and receiving approval are different stages.
Regulation Article 22(1) provides for removal of the application from processing if notified missing or supplementary information and documents are not supplied within thirty days. Keep the actual notice, requested item, stated period and submission receipt; do not wait until the last day. Article 22(2)’s ninety-day determination period starts with complete delivery to the competent authority. Do not count it merely from opening an online form or treat expiry as automatic approval.
7. After refusal, connect the evidence file with service records
Article 36 includes failure to meet, or subsequent loss of, the requirements among grounds for refusal, cancellation and non-extension. Obtain the actual reason: income, insurance, relationship or another ground. Under Article 25, service must explain remedies and the relevant rights and obligations. A deficiency request, removal from processing, refusal and separate removal order are different measures; obtain each full document.
For an ordinary annulment claim, examine administrative-court jurisdiction and, absent a special rule, venue where the authority issuing the measure is located. Under Article 7 of the Administrative Judicial Procedure Law, the general period is sixty days from the day following written notification unless a special period applies. This is an administrative litigation period, not civil debt limitation. Article 27 provides that filing does not automatically suspend the measure; separately assess a stay of execution. Do not apply that general period to a separate removal or detention measure.
8. A sound file keeps the requirements distinct
Organise preparation into six groups: identity/status and family relationship; income declaration or records; health coverage for family members; address and accommodation; criminal record and other requirement evidence; and application, deficiency, decision and service history. The full interactive guide helps select available records and identify the next review step. It requests no personal amounts, names, addresses or uploads and assigns no eligibility score.
Under Article 34, a family permit may be granted for up to three years at a time and cannot exceed a foreign sponsor’s permit duration. The ceiling does not promise three years for every applicant. Even if the declaration rule, insurance coverage or relationship is established, examine the remaining conditions separately. The aim is to submit the right person’s accurate evidence at the right procedural stage, rather than conceal a deficiency.
